Após um dia inteiro de discussões, o Supremo Tribunal Federal (STF) continuará a partir das 14h desta quinta-feira (12) decidir a ação que descriminaliza a interrupção de gestações de anencéfalos. O placar é de 5 x 1 a favor da iniciativa, com expectativa de que uma maioria venha a ser formada, no mínimo, com o voto do ministro Carlos Ayres Britto – levando-se em conta seus julgamentos anteriores.

Quatro ministros ainda devem votar. Cinco ministros, o relator Marco Aurélio de Mello, Rosa Maria Weber, Joaquim Barbosa, Luiz Fux e Cármen Lúcia, já foram favoráveis à ação, evocando princípios de manutenção do Estado laico e de dignidade da vida da mãe. Ricardo Lewandowski abriu a dissidência, sob a justificativa de que o Poder Legislativo não permite o aborto de anencéfalos.

Apenas o ministro Dias Tóffoli não participa do julgamento, porque já tratou do caso quando era advogado-geral da União. Com mais um voto favorável, e desde que nenhum voto seja mudado - o que pode acontecer até a proclamação do resultado -, a interrupção de gravidez de anencéfalo não será crime.
Os críticos do aborto de bebês nessa situação citam um caso de 2008 em Patrocínio Paulista, interior de São Paulo. Marcela de Jesus Ferreira sobreviveu um ano e oito meses porque a ausência de cérebro não era total. Marco Aurélio de Mello disse inclusive em seu pronunciamento que o caso não era de anencefalia.
