Leia a integra da Nota: Nota da CNBB sobre o aborto de Feto “Anencefálico” Referente ao julgamento do Supremo Tribunal Federal sobre a Arguição de Descumprimento de Preceito Fundamental nº 54 A Conferência Nacional dos Bispos do Brasil – CNBB lamenta profundamente a decisão do Supremo Tribunal Federal que descriminalizou o aborto de feto com anencefalia ao julgar favorável a Arguição de Descumprimento de Preceito Fundamental n. 54. Com esta decisão, a Suprema Corte parece não ter levado em conta a prerrogativa do Congresso Nacional cuja responsabilidade última é legislar. Os princípios da “inviolabilidade do direito à vida”, da “dignidade da pessoa humana” e da promoção do bem de todos, sem qualquer forma de discriminação (cf. art. 5°, caput; 1°, III e 3°, IV, Constituição Federal), referem-se tanto à mulher quanto aos fetos anencefálicos. Quando a vida não é respeitada, todos os outros direitos são menosprezados, e rompem-se as relações mais profundas. A ética que proíbe a eliminação de um ser humano inocente, não aceita exceções. Os fetos anencefálicos, como todos os seres inocentes e frágeis, não podem ser descartados e nem ter seus direitos fundamentais vilipendiados! A gestação de uma criança com anencefalia é um drama para a família, especialmente para a mãe. Considerar que o aborto é a melhor opção para a mulher, além de negar o direito inviolável do nascituro, ignora as consequências psicológicas negativas para a mãe. Estado e a sociedade devem oferecer à gestante amparo e proteção Ao defender o direito à vida dos anencefálicos, a Igreja se fundamenta numa visão antropológica do ser humano, baseando-se em argumentos teológicos éticos, científicos e jurídicos. Exclui-se, portanto, qualquer argumentação que afirme tratar-se de ingerência da religião no Estado laico. A participação efetiva na defesa e na promoção da dignidade e liberdade humanas deve ser legitimamente assegurada também à Igreja. With this decision, the Supreme Court seems to have considered the prerogative of Congress whose ultimate responsibility is to legislate. The principles of "inviolable right to life," the "human dignity" and promoting the welfare of all without any discrimination (cf. art. 5 °, caput, 1 ° and 3 ° III, IV , the Federal Constitution), refers to both the woman and anencephalic fetuses. When life is not respected, all other rights are disregarded, and break the deeper relationships. The anencephalic fetuses, like all innocent and fragile beings, can not be discarded and not have their basic rights trampled! The gestation of a child with anencephaly is a tragedy for the family, especially her mother. Consider that abortion is the best option for women, and denying the inviolable right of the unborn child, ignores the negative psychological consequences for the mother. State and society must offer support and protection to pregnant women In defending the right to life of anencephalic, the Church is based on an anthropological view of human beings, based on theological arguments ethical, scientific and legal. Excludes, therefore, any argument that says that this is interference of religion in the secular state. Effective participation in the defense and promotion of human dignity and freedom must also be reasonably assured to the Church.
